1. DEFINITIONS

The AITEND Platform deeply cares about your privacy. We designed this privacy page to help guide you through the type of data we collect and what we do with it. Please take some time to review the policies, as by using the AITEND platform you are agreeing to all of them.

2. ACCEPTANCE

This document represents a contract established between you and STUBMIX, UNIPESSOAL LDA, headquartered at Rua 1º de Maio, 81, 1, Loja E, ZIP Code 7300-205, district of Portalegre, municipality of Portalegre, parish of Sé e São Lourenço, PORTUGAL, duly registered under number 517420961, represented by its legitimate representatives. All rights reserved.

These Terms of Use govern your interaction with the AITEND platform, without disregarding the validity of the legislation in force in each country where the AITEND platform operates. If you do not agree with the terms stipulated here, please avoid using this platform.

By using this platform, you acknowledge that you have reviewed and agreed to the terms of use presented in this document. Therefore, we ask that you review them thoroughly, as using this service implies full acceptance of all terms and a commitment to comply with them.

By using the AITEND platform, you automatically agree to the terms of this contract and assume full responsibility for all actions taken by you on AITEND or related services. AITENDAI-powered virtual assistants are computer programs designed to enhance operational efficiency in sales and customer service through task automation and intelligent customer interaction. These virtual assistants are trained to understand and respond to inquiries, perform specific actions, provide relevant information, and personalize interactions based on customers' individual needs. Using advanced machine learning algorithms, these assistants help businesses optimize operations, increase customer satisfaction, and drive business growth by providing a more effective and personalized user experience.

API:The acronym stands for Application Programming Interface. It is a set of programming routines and standards for accessing a software application or web-based platform.

USER:The term "USER" refers to the entity, company, non-governmental organization, or civil association invited to use the workflows available on AITEND. By accepting these conditions, the USER agrees to create automated communication flows with their customers, as stipulated in this document.

CLIENTS: The term "CLIENTS" refers to individuals or entities, whether individual customers or legal entities, who have received messages through the AITEND platform as part of the automated interactions promoted by the USER.

CHANNELS: This is where interaction between a person and the bot (robot) occurs. This happens when you create a flow. Therefore, it serves as the means by which messages are delivered to the customer. Through channel management, you can conduct campaigns and collect data for desired purposes. Currently, AITEND supports the WhatsApp channel.

MESSAGES: The data that travels through the channels.

FLOW: These are interactive ways to show how information is disseminated or how data is collected. The creation of visual and intuitive flows allows for precisely defining which messages are exchanged with customers.

CAMPAIGNS: A tool within the platform that enables continuous customer contact, automating the system's periodicity to reach out again with new information, collect new data, or check if a certain situation has changed.

TRIGGERS: Enables the system to react to external stimuli and determine how it responds when receiving a text message through a channel.

3. SERVICE

The service provided is the supply of AI-powered virtual assistants to improve operational efficiency in three key areas: sales, customer service, and marketing.

It allows users to automate tasks, interact intelligently with customers, and personalize their communication approaches according to the available privacy policy.

4. STEP BY STEP

From your own access account, using your confidential and unique login and password, you will have access to the platform's home page.

To get started, the first step is to add a channel, which consists of a phone number or social media account that AITEND can use to send and receive messages on your behalf. You can choose to use an Android phone and your own mobile plan, or we can connect you directly to a service provider in your country.

5. AMENDMENTS, MODIFICATIONS, AND TERMINATION

AITEND reserves the right to modify these terms at any time, including adding, removing, or altering any of its elements. Such modifications will take effect immediately. By making these changes available, and by continuing to use the platform, you indicate your acceptance and agreement to follow the revised terms.

AITEND also reserves the right to suspend or terminate your access to the platform at any time if there is suspicion of fraud, obtaining unfair advantages, or non-compliance with the conditions set forth in these Terms of Use, the Privacy Policy, or applicable legislation. In these situations, you will not be entitled to any compensation, and AITEND may take appropriate measures to remedy the situation if necessary, as well as take all other actions necessary to protect its interests.

6. ACCESS AITEND

To use AITEND, you must be at least 18 years old.

7. LIMITATIONS OF LIABILITY

You are solely responsible for using AITEND and must comply with these Terms of Use as well as applicable laws.

Under no circumstances shall AITEND, its controller, affiliates, partners, or employees be liable for any direct or indirect damages resulting from or in connection with access, use, or inability to access or use the platform.

GIVEN THE ONLINE ENVIRONMENT OF THE INTERNET, AITEND IS NOT RESPONSIBLE FOR INTERRUPTIONS OR SUSPENSIONS OF CONNECTION, INCOMPLETE OR FAILED DATA TRANSMISSIONS, AND TECHNICAL PROBLEMS OF ANY KIND, INCLUDING BUT NOT LIMITED TO MALFUNCTIONS OF NETWORKS, HARDWARE, OR SOFTWARE. THE UNAVAILABILITY OF INTERNET ACCESS OR AITEND FEATURES, AS WELL AS ANY DIFFICULTY IN THE CORRECT USE OF AITEND, SHALL NOT BE CONSIDERED THE PLATFORM'S RESPONSIBILITY. AITEND DISCLAIMS ANY LIABILITY FOR USER ACTIONS AND/OR POSSIBLE FAILURES.

The security of your device environment (computer, mobile phone, tablet, etc.) is your responsibility, and you should use available tools such as antivirus and firewall, among others, to prevent cyber risks.

The AITEND platform may contain links to third-party websites and applications. This does not imply in any way that AITEND endorses, verifies, guarantees, or has any connection with the owners of these websites or applications, and is not responsible for their content, accuracy, policies, practices, or opinions. We recommend that you read the terms of use and privacy policies of each third-party website or service you visit or use.

8. CONTENT AVAILABILITY

AITEND may, at its sole discretion, allow you or any other user to submit, post, or provide content information, such as text, audio, or video, on the platform ("User Content").

Any User Content that is defamatory, libelous, abusive, violent, pornographic, obscene, offensive, or illegal, as determined by AITEND at its sole discretion, including information protected by third-party copyrights or trademarks without the express permission of the rights holder, will not be the responsibility of AITEND.

Please note that any User Content provided by you remains your property.

9. LEGAL RESTRICTIONS

YOUR CONTENT: You are solely and exclusively responsible for the content of the texts made available in the conversations, ensuring that the content will not violate or cause undue exposure or embarrassment to end users, also being responsible for your content in court or out of court, and unconditionally exempting AITEND from any joint or subsidiary liability for any Claims, given the intermediary nature of the service that AITEND is providing to you through the use of AITEND Flows.

You must also ensure that your content, contributions, and use - and the use by end users - including your offers and services, do not violate any applicable Policy or Law. You are fully responsible for the development, content, operation, maintenance, and use of your content, submissions, and offers and services made available. You may not, under any circumstances, provide Content that:

a) is false or misleading, or offers Content that is not what the user will engage with, attempting in any way to deceive/induce and/or offend the law, morality, or commercial ethics;

b) invade the privacy of others or harms their image or honor in any way, or further promotes any form of racism or discrimination against minority groups, or advocates intolerance, prejudice, religious or political fanaticism, or discrimination against groups of people or ethnic groups, as well as containing obscene content such as pedophilia and other sexual crimes, are in any way prohibited or not recommended for a particular age group, or defend or apologize for drugs and drug trafficking, narcotics, cigarettes, alcoholic beverages, or illegal games;

c) Content that violates third-party rights, including but not limited to copyright, and/or the creation and dissemination of Content that you are not authorized to do and offering illegal and/or pirated Content, infringing third-party copyrights and property rights.

YOUR CLIENT: The end users of the services and/or products offered by you through AITEND, have a unique and exclusive relationship with you, therefore, you are also responsible for the use of your Content and offers used by your end-user client. Therefore, you will indemnify AITEND and will be responsible for ensuring that all end-users comply with the applicable Policies and/or Laws. Additionally, if you become aware of any violation of your obligations described in this Terms of Use, caused by an end-user of your account, you must immediately suspend access to your Content, the offers and services provided, and AITEND will temporarily suspend access to AITEND streams until the issue is resolved.

10. COPYRIGHT INFRINGEMENT COMPLAINTS

Copyright infringement claims regarding any content available on the AITEND platform must be sent via email to terms@aitend.me.

11. GENERAL INFORMATION

These Terms of Use are governed by the laws of Portugal. Any doubts or situations not covered in these Terms of Use will first be resolved by STUBMIX UNIPESSOAL, and if they persist, they must be resolved through the competent channels of Portugal or through AITEND subsidiaries, excluding any other jurisdiction, regardless of how privileged it may be.
